Warshay Investments (Pty) Ltd T/A KWV and Spar, Win 1 of 50 KWV 5YO 5L Bottles Competition

TERMS & CONDITIONS 

  1. The promoters are Warshay Investments Pty (Ltd) Reg no 2012/018 792/07 ta KWV (“KWV”) and Spar Reg no: 1967/001572/06 (collectively “the Promoters”)
  2. By participation in the KWV Spar, Win 1 of 50 KWV 5YO 5L Bottles Competition (“the Competition”), participants agree and accept the rules set out below. Entry in the Competition constitutes acceptance of these rules.

 

  1. The participating product include KWV 5 Year Old Brandy (750ml).
  1. This offer may not be used in conjunction with any other offer of the Promoter.
  1. The Competition starts on 02 October 2023 and ends on 13 November 2023. Any entries received after the closing date of 13 November 2023 will not be considered, regardless of the reason for the late receipt of the entry.
  1. The Competition is open to all persons of 18 (eighteen) years or older and resident in South Africa. A copy of a participant’s identification document (ID) is required in order to be validated as a winner of the Competition as provided for in paragraph 13 below.
  1. The following persons shall not be eligible to participate in the competition:
    1. a person younger than 18 (eighteen) years;
    2. a director, member, partner, promotional or advertising agent, merchandiser, employee or consultant of the Promoter or any other person who directly or indirectly controls or is controlled by the Promoter, or an organiser of the Competition;
    3. a supplier of goods or services in connection with the Competition;
    4. a person who are not a legal resident or citizen of the Republic of South Africa;
    5. a spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified in paragraphs 7.1 to 7.4 above.
  1. The Promoters may not award a prize to a winner of the Competition if it is unlawful for the Promoters to supply such a prize to that person.
  1. The prizes include:
    1. 1 x KWV 5YO 5L (litre) bottle signed by Eben Etzebeth
    2. Delivery of the prize (within South Africa)
  1. To enter, Entrants will be required to:
    1. Purchase a bottle of KWV 5 Year Old Brandy (750ml) and upload their till slip or receipt as their proof of purchase
    2. Scan the QR Code provided on Point of Sale material or alternatively visit www.kwvbrandy.co.za, click on the competition link to be redirected to the competition site – www.kwvbrandy.co.za/competition
    3. Submit your personal details i.e. full name, ID number, contact number, email address, physical address and date of birth
  1. Participants may enter the Competition unlimited times over the promotional period, provided that the participants purchase the participating products each time they enter the Competition and comply with the Competition rules, subject to the following conditions:
      1. Only one prize shall be awarded per household and per person
      2. Each new entry is accompanied by a unique till slip
  2. Winners will be selected by means of a random draw by 30 November 2023 and will be notified telephonically where the winner will be required to verify their details. The Promoters (or their agent) will endeavour to contact the prize winner once every day for 5 consecutive working days after their name is drawn. If the prize winner cannot be contacted during this period, the prize will be forfeited and another winner will be selected in accordance with the rules.
  1. The Promoters reserves the right to carry out audits in respect of any prize winners to verify their eligibility to win such prizes. A potential prize winner is not an actual winner until his / her submission is validated and his / her document is completed and submitted to the Promoters along with any other information which the Promoter might require. If a potential prize winner does not meet the eligibility requirements which shall be determined in the sole discretion of the Promoters, the prize will be forfeited and a runner-up finalist will be deemed the potential prize winner, subject to the terms and conditions stipulated herein.
  1. The judges’ decision is final and no correspondence will be entered into.
  1. Winners may be required to complete and submit an information disclosure agreement to enable the Promoters to ensure compliance with these rules. Should the winner be found not to have complied with these rules, he / she will automatically be disqualified and the prize will be forfeited. Winners will be required to sign acceptance of prizes and indemnity documents.
  1. By entering the Competition, participants authorise the Promoters to collect, store and use (not share) their personal information for communication or statistical purposes. Winners are entitled to decline to participate in any marketing activity.
  1. The Promoters reserve the right to name winners publicly. By entering this promotional competition, prize winners agree to the publication of their names and likenesses by the Promoters. Participants will not be entitled to any payments or other remuneration for such publications or otherwise.
  2. Any personal information submitted by the participant will be used solely for this competition and in accordance with current South African data protection legislation, the Consumer Protection Act and the Promoters’ respective privacy policies.
    1. The legal basis for processing collected personal information is that processing is necessary to allow the participant to enter and to meet the legal requirements applicable to the “Competition”.
    2. This information may be shared with authorised KWV representatives (internal and contracted external parties) as required for business and legal purposes.
    3. As a participant you have the right to request access, change, or remove your personal, for more information on KWV’s privacy policy, please visit our website.
  3. The Promoters shall not be responsible for any lost, damaged, delayed, incorrect or incomplete entries for any reason whatsoever. Proof of sending will not be accepted as proof of receipt. 
  4. These rules may be amended by notification at any time during the Competition.
  1. The prize is exclusively for the prize winner and is not transferable or exchangeable. Merchandise cannot be substituted for cash.
  1. The prize will be delivered or handed to the verified and eligible winner within 30 (thirty) days of winning the prize (i.e. the draw date as stipulated in paragraph 12 above). The winner must provide an accurate delivery  address as well as a daytime contact number to enable the courier to deliver the prize to the winner of the Competition, failing by which the prize will be forfeited.
  1. Return of any prize notification as undeliverable or failure to reply as specified in the notification (and within the time stated) will result in disqualification and selection of an alternate winner.
  1. The Promoters may make media announcements or publications of the names and/or photographs of any prize winner(s), subject thereto that the prize winner(s) may expressly elect to decline the use of his or her image in marketing material of the Promoter.
  1. No “automated” entries will be allowed and all entries must be made by a natural person manually on the platform where the Competition is hosted.
  2. If any entry has been made in any manner which in our discretion may provide a participant with an unfair advantage over other participants, such participant will be automatically disqualified from that and all future competitions run by the Promoter.
  3. Income and other taxes, if any, are the sole responsibility of the winner.
  1. All participants and prize winners hereby indemnify the Promoters and its agents against any and all claims for any injury, loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever relating to their participation in any way whatsoever in the Competition.
